Former Anthrax guitarist  was arrested on Christmas Day after an incident at his Lake Worth, Fla. home and booked on suspicion of domestic violence. Now, the prosecutors have revealed they won’t pursue charges against Spitz.

According to Gossip Extra, Spitz’s wife Candi asked that the case be dropped, and prosecutors determined they couldn’t proceed without her testimony.

In the police report on the incident, Spitz and his wife had reportedly been drinking when things turned contentious. Candi told police that her husband allegedly wrapped his hands around her throat and tried to choke her. Spitz claimed that his wife attacked him first, and deputies also noted scratches on his chest, neck and arms. Spitz ended up spending Christmas Day in jail.

As to what triggered the incident, Candi Spitz told Gossip Extra that pressures at home contributed to it. “The stress level at home has been astronomical,” she said. “Our children are both autistic and Dan may have early onset Parkinson’s Disease. We were all drinking wine, and he just snapped.”

Spitz was Anthrax’s guitarist from 1983 to 1995, then rejoined the band from 2005 to 2007. In 2010 he formed the band Red Lamb, who released their self-titled debut in 2012. The album was co-produced by Megadeth frontman Dave Mustaine, who also co-wrote lyrics with Spitz.

One of the songs on the album is ‘Puzzle Box,’ which is described as ” a walk through the daily life of a family with identical mirror image twins who are both Autistic. It is a moving experience of reality that the Spitz family lives.”
