Ozzy Osbourne’s Ozzfest Files Suit Against New York-Based OZY Fest

“Festivals will never be the same,” boasts OZY Fest, but the organizers of Ozzfest think the name and logo of the New York City based music event is a bit too close to their own long running metal-based festival.

According to The Wrap, Monowise Limited Corporation (MLC), the company behind Ozzy Osbourne‘s long running Ozzfest, has filed a suit against the organizers of the OZY Fest festival, claiming that the festival’s logo is way too close to the MLC trademark.

The cease and desist order, filed against OZY yesterday (Oct. 18), says that the OZY Fest marks, “are nearly identical in sight, sound, connotation and commercial impression to MLC’s well-known Ozzfest mark.” The logo for OZY Fest can be seen below.

“Defendants’ OZY Fest Logo consists of psychedelic imagery, which consumers associate with rock music,” the lawsuit continues. “On information and belief, defendants intentionally use brightly colored-in blots and paint splatter in their OZY Fest Logo to create psychedelic imagery, and for the express purpose of impressing upon consumers that defendants’ festival includes rock music, just like MLC’s Ozzfest event.”

OZY is a news site founded in 2013 which focuses on original content. This year’s OZY Fest took place in Central Park over the summer and featured a host of politicians, comedians and pundits along with music from Jason Derulo and Talib Kweli spread across three stages over 10 hours. It was the second year for the event.

Though it started as a touring festival, this year’s Ozzfest is now a destination event, paired up with Slipknot‘s brainchild Knotfest and billed as Ozzfest Meets Knotfest. It features a slew of hard rock and metal acts hitting the Glen Helen Amphitheater in San Bernardino, Calif. the weekend of Nov. 4 and 5. Ozzy Osbourne will be leading the Ozzfest portion with direct support from Prophets of Rage. Meanwhile, Rob Zombie and Marilyn Manson head up the Knotfest portion, with the Corey Taylor-led Stone Sour also set to play the day.
