All four members of Decapitated have now made their first appearance in a Spokane County court as they were informed of the alleged kidnapping and gang rape charges against them and bond was set for each of the men.

According to the Spokesman Review, singer Rafal Piotrowski and bassist Hubert Wiecek had their first court appearance on Friday (Oct. 20), where a Polish translator relayed from Judge John Clooney that Piotrowski was charged with first-degree kidnapping and second-degree rape charges, while Wiecek was charged with first-degree kidnapping and third-degree rape.

Back on Oct. 13, bassist Waclaw Kielyka and drummer Michal Lysejko had their first appearance in the Spokane court after being extradited from Santa Ana, Calif. Both men were charged with first-degree kidnapping, while Kieltyka had a second-degree rape charge and Lysejko had a third-degree rape charge.

All four band members had their respective bonds set at $100,000, were forced to surrender their passports and have not been allowed to speak to each other while incarcerated. Attorney Jeffry Finer, who represents Piotrowski, told the Spokesman Review that each of the musicians will be pursuing bail, but are waiting on documents from Poland to arrive, which could take over a week.

The musicians were incarcerated due to an alleged incident that occurred after an Aug. 31 show at The Pin club in downtown Spokane. According to the court documents, two women reveal they were invited onto the band's tour bus following the show. One of the women stated that when she went to the bathroom, she was allegedly grabbed and turned to face the sink and the mirror where she was allegedly raped by each of the members. The other woman said in a statement to police that she was able to escape after kicking one of the band members in the groin.

After their initial arrest, the band issued a statement which read, "While we are not perfect human beings, we are not kidnappers, rapists or criminals. As such, we strongly deny the allegations that have recently been brought against us. We ask that everyone please reserve their judgement until a definitive outcome has been reached, as charges have yet to be pressed. Full testimony and evidence will be presented in due time, and we have faith in that process."

A second statement followed their extradition, which read, "An update – following extradition from California to Washington, the band has now been charged. We’d like to emphasise; the Spokane Police Department has pressed charges as procedural formality, without doing so, they would be forced to release band – this is not a conviction or any indication of guilt or innocence. Once again, we ask that everyone wait for each party’s case to be presented and await the court’s decision. With that said, whilst cases are being prepared on both sides, some facts are indisputable at this point – that the original officer who took the complaint from the accuser stated, 'I do not have probable cause that a rape occurred,' and it’s taken a full 30 days to file charges, which is right up against the point at which the defendants would legally have had to be released. The band firmly refutes the allegations and are confident that once the facts and evidence have been seen and heard, they will be released and able to return home. Individuals who were present on the night in question with information about the case are asked to reach out to the defense lawyer, Steve Graham of Spokane, Washington."
